The following Terms of use are for KKBOX and other services provided by our designated service providers.

TERMS OF USE FOR AWA DESIGNATED PROCESSOR COOPERATIVE SERVICES
Wherein AWA (hereafter referred to as “the services”) is a content delivery service provided by AWA Co. Ltd. (hereafter referred to as “AWA”).
Section 1 General Rules
Article 1 (Terms)
- These terms apply to all services utilized by the user, including the services applications (hereafter referred to as "the applications"), the services website, contents provided in the services, and accompanying products and services.
- The user shall be deemed to have agreed to these Terms and Conditions at the time of use of the Service through the application method for the Service specified by a Processor prescribed by the Company in the following List of Specified Processors (hereinafter referred to as “Other Processor”) listed in the list of service providers designated by us.
- AWA may revise these terms when it is in the general benefit of the user and does not run counter to these terms. In such a case, the user shall be subject to the altered terms.
- Before AWA makes revisions to these terms, it shall determine the time when the revisions shall become effective, and after they have been revised, shall notify the user through the method specified in Article 4 regarding the revisions to these terms and the date the revisions have gone into effect.
Article 2 (Required Environment)
Connection to Internet service is required to use this service.
Article 3 (Users)
The term “user” as used in these Terms of Use shall mean a person who uses the Service after clicking on a URL that directly transitions to the Service issued by Other Processor.
Article 4 (Notification to Users)
AWA will notify users of necessary information by method that the company deems to be appropriate, which may include notifications regarding websites, etc operated by AWA.
Article 5 (Assignment of Rights)
All rights including copyrights, trademarks, and rights of publicity relating to any of the data, documents, sounds, graphics, illustrations, information, and the application provided through the services belong to AWA or the third parties with said rights.
Section 2 Users and Paying Members
Article 6 (Use of the Services, etc.)
- Minors must obtain the consent of a parental authority to use the services.
- AWA may discontinue providing the services at any time if it has been determined or found that either of the following items applies to a user of the services.
- Compulsory discontinuation of services has occurred in the past due to a violation of these terms
- AWA otherwise deems that a user is ineligible for services
Article 7 (Settlement and Billing Methods)
Users shall pay the cost of purchasing the paid items set forth in Article 11 (“Paid Item Purchase Fees”) in the manner set forth in each of the following items.
- This service uses the automatic renewal subscription billing functions provided in the App Store, Google Play, Stripe, and Boku Managed Subscription services or the billing functions prescribed by Other Processor (hereinafter collectively referred to as the "Billing Functions") of Stripe, Inc., or Other Processor (hereinafter collectively referred to as the "Billing and Receipt Agents") that perform billing and receipt agent tasks. (The Stripe function is linked to AWA's official website https://awa.fm.) The information fees are billed and received by means of settlement and payment of Billing Functions provided by Billing and Receipt Agents, paying members are deemed to accept it.
- Users shall pay the fee for the purchase of paid items to the Billing and Receipt Agents in accordance with the terms and conditions of a separate contract between the user and the Billing and Receipt Agents. If a user does not comply with the terms of the contract with the Billing and Receipt Agents, the user may be denied use of this service.
- Users shall resolve disputes with Billing and Receipt Agents in connection with the payment of paid item purchase fees at their own responsibility and expense, and shall not cause any inconvenience or damage to the Company. In addition, the Company shall not be liable for any damages incurred by the user as a result of such disputes.
- If AWA suffer damages as a result of a dispute between a user and a Billing and Receipt Agents, said user shall compensate us for such damages at AWA request.
Article 8 (Forced Termination of Service)
AWA may terminate provision of the services to any user for whom the following apply:
- Conducted actions prohibited by these terms
- Any other action in violation of these terms
- In addition to the foregoing three items, any circumstances wherein AWA deems forced termination is appropriate
Article 9 (Prohibited Actions)
Users are prohibited from executing the following actions when using the services:
- Actions such as copying, distributing, transferring, lending, publicly transmitting or reverse engineering any data, information, text, sound, video, or illustration provided through the services (hereafter collectively referred to as "data, etc.") that exceed the range of private use authorized by copyright.
- Actions that infringe or may possibly infringe on the property, privacy, or image rights of an artist or other third-party.
- Slander or other actions that discredit or defame or may possibly discredit or defame an artist or other third-party.
- Reselling via an Internet auction, transferring, lending or changing the name of the rights that are possessed based on their qualifications as a member to a third party or presenting the aforementioned rights to establish a right of pledge or offering them as any sort of collateral.
- Compel contact or meeting with an artist, or request contact or meeting with an artist to AWA or its group affiliate companies.
- Conducting profit-making activities or preparatory by using the services either for personal gain or for the profit of third parties (hereafter referred to as "business activities").
- Using the services for pre-election activities, election activities, or similar activities or violations of any public election laws.
- Using the services to conduct activities associated with religious groups such as proselytizing, the establishment or activities of religious organizations, or participation in religious organizations.
- In addition to the above items, conducting any activity in violation of law or public order or activities that interfere with the operation of the services.
Section 3 Community Functions
Article 10 (Adhering to AWA Community Guidelines)
This service enables the use of features (hereinafter collectively referred to as "AWA Community Features") that allow users to post and communicate, including comments, chat, and live streaming, within the music streaming service AWA operated by AWA Co. Ltd. (hereinafter referred to as "our company").When using the AWA Community Functions , users are subject to these Terms of Use and the "AWA Community Guidelines" separately specified by our company. Users are required to adhere to both these Terms and Conditions and the AWA Community Guidelines.
Article 11 (Paid Items)
- In a portion of AWA's community functions, users may purchase paid items, such as items that allows the user to send special messages, (hereinafter referred to as "paid items") through methods specified by the company. When purchasing a paid item, there is a need to pay the unit price set for each paid item displayed in the service.
- Should a user purchase a paid item, a contract regarding the purchase of the paid item shall be concluded between the company and the user at the moment that there is a display that the prescribed payment process has been completed after the user presses the purchase button. Additionally, should the user be a minor or have limited legal capacity and require the consent of a guardian or other individual with the authority to conclude the corresponding contract, the user must be sure to receive the consent of the guardian or other individual with authority (for example, a person with parental authority or another legal representative for a minor) before purchasing a paid item.
- Paid items can only be used in AWA's community functions.
- Paid items shall be consumed at the moment that the user purchases the paid item. Accordingly, paid items are not stored or saved in the service.
- A paid item that has been purchased cannot be refunded for any reason.
Section 4 Other
Article 12 (System Requirements)

*We do not provide support to devices that have OS other than the system requirements because it may not work properly.
Article 13 (Modifications in Service Content, etc.)
- AWA may modify content of the services, including content or benefits provided in the services, without prior notice to users. Provided, however, AWA will notify users in advance within a reasonable period if it is of serious disadvantage to users.
- In the event of aforementioned modifications, AWA shall notify users after the fact by the method stipulated in Article 4.
Article 14 (Interruption of Services)
AWA may interrupt or discontinue provision of all or a part of the services without prior notice to users due to system maintenance or other unforeseen operating circumstances related to the services.
Article 15 (Cessation of Services)
- AWA may cease to provide the services if it deems that there is difficulty in continuing operation of the services.
- In the event of aforementioned cessation of services, AWA will not provide refunds to users of information fees that have already been paid.
Article 16 (Advertising)
- AWA may place advertisements for AWA or third parties in this service.
- The use of advertiser content, advertisements, products, services, etc. shall be judged by the user at their own risk; AWA shall bear no responsibility for damage caused to users originating from their usage or inability to use such.
- If an advertisement as per item 1 is a reward advertisement and the operation performed by the user is to download or run an application provided by the advertiser, AWA shall bear no responsibility for damage caused by the application, including operation of the application, the malfunction of devices possessed by the user, etc.
Article 17 (Handling of Personal Information)
Matters relating to handling of information of users of the services (including information concerning users' terminal usage history of the services and/or other services, terminal identification information and user personal information) shall be in accordance with our separately stipulated Privacy Policy and within the scope required to accomplish the purpose of use described therein.
This Privacy Policy constitutes a part of the Terms of Use. If you do not agree to the terms of this Privacy Policy, please refrain from using the service.
Article 18 (Exclusion of Relations with Antisocial Forces)
- The user warrants that the user is not currently nor will in the future be associated with an Organized Crime Group or any other antisocial force.
- If the user violates or is suspected to violate the preceding paragraph, we reserve the right to suspend the service for the user and cancel our agreement with the user in accordance with the provisions of these Terms of Use. Additionally, we will not be liable for any consequential damages or losses that occur.
Article 19 (Compensation for Damages)
- The user accepts all responsibility for compensation in the event that damages to AWA or other third parties occur through the fault of the user related to the use of the services.
- In the event of receipt of claims or requests from other users or from other third parties regarding use of the services, or in the event that disputes arise, the user shall assume responsibility and expense to resolve these.
Article 20 (Immunity)
- With the exception of when the cause is attributable to AWA, AWA shall bear no responsibility for damages to the user due to their own usage or inability to use the services.
- Even if the damages in the preceding paragraph are caused by AWA's negligence, AWA's liability for damages shall be limited to the extent of damages that could ordinarily arise.
Article 21 (Matters for Discussion)
In the event that matters not stipulated in these terms or doubts in the interpretation of these terms should arise, the user and AWA shall resolve these in good faith through mutual discussion.
Article 22 (Governing Law, Jurisdiction)
- Use of the services and interpretation and application of these terms shall be governed by the laws of Japan.
- In the event that conflict is needed between the user and AWA regarding the services or these terms, the user agrees that the Tokyo District Court or the Tokyo Summary Court shall be the court of first instance of exclusive jurisdiction.
